Terms and Conditions
Your Mitsubishi dealer is a dealer of the Colt Car Company Limited (trading as Mitsubishi Motors in the UK). Your Mitsubishi dealer is participating in the Mitsubishi 24 hour test drive promotion, which gives eligible drivers the opportunity to test drive a Mitsubishi for a period of 24 hours (the “Test Drive”).
The following Terms and Conditions set out the agreement between your Mitsubishi dealer and you (“Driver”) under which your Mitsubishi dealer will supply a Mitsubishi (the “Vehicle”) for the Test Drive.
Availability: The Test Drive is available during the period 27th June 2019 until 31st March 2020, subject to availability. Your Mitsubishi dealer cannot guarantee availability. Driver is limited to one Test Drive.
Term of Test Drive: Unless otherwise agreed with your Mitsubishi dealer, Driver may use the Vehicle for a single continuous 24 hour period starting at the time of collection.
Eligibility: In order to qualify for a Test Drive, Driver must:
- be aged 25 or over;
- possess a full, current UK or EU driving license, which has been valid for at least one year;
- have fewer than six penalty points on their licence; and
- never have been subject to any disqualification from driving.
Your Mitsubishi dealer reserves the right to impose additional criteria and require further proof of identity. Your Mitsubishi dealer reserves the right to decline any request for a Test Drive, at its sole discretion.
Insurance: The Vehicle will be covered by fully comprehensive insurance during the Test Drive. An insurance excess will be applicable, the amount will be confirmed by your Mitsubishi dealer prior to the Test Drive. Driver is responsible for the payment of any excess.
Collection: Driver must contact the dealer at least 48 hours before the desired test drive date to arrange the date and time for collection and return of the Vehicle. The Vehicle must be collected from the dealer’s premises and returned to the same premises, during normal working hours. Prior to the start of the Test Drive, Driver must allow at least one hour for the completion of checks, review of documentation and vehicle hand-over. Driver will be required to sign a vehicle inspection report at both collection and return of the Vehicle.
Documentation: Driver will be required to provide photo identification and details of their driving licence. Further documentation may be required by your Mitsubishi dealer.
Mileage allowance: The mileage allowance for the Test Drive is 200 miles, any mileage exceeding 200 miles will be charged at 15 pence (plus VAT) per mile. The Vehicle must not be taken outside of the United Kingdom.
Return: The Vehicle must be returned at the stipulated collection time and place. Your Mitsubishi dealer reserves the right to charge Driver a reasonable daily rental rate for the Vehicle if it has not been returned 30 minutes after the stipulated return time.
Fuel: The Vehicle must be returned with the same amount of fuel as when it was collected. If the Vehicle is returned with less fuel, Driver will be charged for the variance.
Personal Property: Any property carried or left in the Vehicle is at Driver's own risk. Dealer does not accept any liability for loss or damage to any personal belongings left in the Vehicle during the Test Drive or when it is returned to Dealer.
Title: Title to the Vehicle remains at all times with your Mitsubishi dealer.
Condition: Drivers must take good care of the Vehicle and ensure that the Vehicle remains in a roadworthy condition and return it in the same condition as when it was collected. Driver must at all times keep the Vehicle secure and should ensure that the Vehicle is locked and safe when it is not being used. No accessories or parts are to be removed from or affixed to the Vehicle. The dealer may charge Driver for any damage and/or missing items.
Fines and Penalties: Driver will be responsible for payment of any charges, penalties and fines incurred during the Test Drive, including but not limited to parking or speeding fines or Congestion Charges. The dealer may choose to pay such costs and recharge Driver the amount of the charge/penalty/fine plus an additional £30 administration fee.
Notification to authorities: The dealer shall not be prevented from supplying details of Driver's name and address in response to any request from police and other relevant authorities for the purposes of identifying the user of a vehicle at a particular date and time in respect to any alleged speeding / parking fines; penalties and motoring offences and Congestion Charges.
Responsibility: Driver shall use the Vehicle in a responsible and safe manner and in accordance with the relevant road traffic acts and any other applicable legislation. The Driver shall be liable for any injury to persons or any damage to any vehicles or property which occurs as a consequence of the Driver’s use of the Vehicle.
Accidents: Driver must immediately inform the dealer of any accident involving the Vehicle, if the Vehicle is stolen or if any damage is caused to the Vehicle. The Driver must comply with any subsequent instructions provided by Dealer, including any instruction to return the Vehicle to the dealer.
Dealer Liability to Driver: Dealer is only responsible for loss or damage which the Driver suffers that is a foreseeable result of Dealer’s breach of these Terms and Conditions. The following types of loss are wholly excluded: loss of profits; loss of sales or business and indirect or consequential loss. To the fullest extent permitted by law, Dealer excludes all warranties, conditions and other terms implied by statute or common law.
Limit of Liability: Nothing in these Terms and Conditions limit any liability which cannot legally be limited, including but not limited to liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; and
- any other matter which it would be illegal to exclude or attempt to exclude liability.
Breach by Driver: Dealer may terminate the Test Drive with immediate effect, by notifying Driver, in the event that Driver is in breach of any of these Terms and Conditions.
Governing law: These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, shall be governed by, and construed in accordance with, the law of England and Wales.
Jurisdiction: Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or their subject matter or formation.
Variation: No variation of these Terms and Conditions shall be effective unless it is in writing and signed by the parties (or their authorised representatives).
Third parties: Only Driver has rights under these Terms and Conditions. No other person shall have any rights under these Terms and Conditions
Entire agreement: These Terms and Conditions constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
